My advice on how to start the estate planning process.
How do I start planning my estate?
I am an estate planning attorney so this may not be surprising, but in my opinion, the first thing to do is find an estate planning attorney. By speaking with a professional about your assets, family, goals and concerns, you can get a better idea of the process and the application of the estate plan in your life.
The next thing you may want to do is write down some of the things you will need when you speak to the attorney. Click here for the Estate Planning Worksheet. By thinking about these things ahead of time, you will likely get more of out the meeting. Also, by filling out the worksheet, you are helping yourself mentally prepare for the estate planning process.
Estate planning is really a simple and empowering tool. I have found that most people put off doing their estate planning because they dread the idea of discussing their incapacity or passing. It is understandably difficult to think of such things. What I have found however, is that while the idea of planning is uncomfortable, the actual planning is empowering. There is a certain ease with which most of my clients think through the process. It feels like spring cleaning, but better. You sort through your property, assets, and think through the distribution.
Another reason many clients have told me they procrastinate is because they think don’t realize that it can be amended and revoked, if necessary. Estate planning documents, usually include a revocable living trust as well as a durable power of attorney, healthcare directive, a will and if needed, a nomination of guardianship. So long as the person is alive and has capacity, those documents can be modified, amended or revoked.
My advice is take the first step. Find an estate planning attorney. Meet or speak with them. Understand why you need or want to start this estate planning process and from that point you will begin to feel more comfortable and ready for planning.
